شورای حقوق بشر همجنسگرایان ایرانی

Iranian Homosexual  Human Rights Council

در شصتمین سالگرد اعلامیه ی جهانی حقوق بشر سازمان ملل متحد که به سال جرم زدایی از همجنسگرایی نام گذاری شده است، در دهم دسامبر دو هزار و هشت، شورای حقوق بشر همجنسگرایان ایرانی  با هدف گسترش حقوق بشر همجنسگرایان تشکیل شد.

الف) اهداف شورای حقوق بشر همجنسگرایان ایرانی

1.       تلاش در گسترش و رعایت حقوق بشر در ایران برای جامعه ی دگرباشان ایرانی

2.       تلاش برای اتحاد و هدفمند کردن سازمان ها، گروه ها و تشکیلات دگرباشان ایرانی

3.       تلاش برای جرم زدایی از همجنسگرایی در ایران

4.       انجام برنامه های مشترک و هدفمند برای رعایت حقوق همجنسگرایان

5.       آگاهی رسانی و تلاش در نشر و ترویج فرهنگ پذیرش اجتماعی همجنسگرایان

ب) اعضای شورای حقوق بشر همجنسگرایان ایرانی

1.       آرشام پارسی مدیر سازمان دگرباشان ایرانی (IRanian Queer Railroad)

2.       آریا ایران آرا مدیر بنیاد همجنسگرایان ایرانی (Iranian Homosexual Foundation)

3.       مانی زانیار مدیر سازمان دفاع از حقوق همجنسگرایان ایرانی (Iranian LGBT Human Rights Organization)

پ) ساختار اداری شورای حقوق بشر همجنسگرایان ایرانی

1.       چنانچه یکی از اعضای هیئت موسسین مایل به ادامه ی همکاری نبود می بایست یک نفر را به عنوان جایگزین خود به شورا معرفی کند و چنانچه هر دو عضو دیگر هیئت موسسین موافق بودند این جایگزینی انجام می پذیرد.

2.       هر کدام از اعضا باید یکی از مسئولیت های رئیس، معاون هماهنگ کننده و دبیر شورا را به عهده بگیرند.

3.       در صورتی که افراد حقیقی یا حقوقی تمایل به همکاری با شورا به عنوان “اعضای ناظر” شورا داشته باشند باید درخواست خود را به صورت کتبی برای دبیر شورا ارسال نمایند و هیئت موسسین باید نسبت به عضویت آنها با توجه به آئین نامه ی داخلی شورا و همچنین میزان فعالیت های شناخته شده ی کاندیدا توافق نظر کامل داشته باشند.

4.       در صورت نیاز اعضای شورا می توانند در جلسات رسمی خود اساسنامه را اصلاح و تکمیل نمایند.

ت) رئیس شورای حقوق بشر همجنسگرایان ایرانی

1.       رئیس شورای حقوق بشر همجنسگرایان ایرانی با رای اعضای هیئت موسسین و برای مدت یک سال انتخاب می شود و تنها می تواند دو دوره ی متوالی این مسئولیت را داشته باشد.

2.       وظیفه ی رئیس شورا تحقق سیاست های کلی تصویب شده در جلسات شورا می باشد.

3.       رئیس شورا باید بر فعالیت های اعضای شورا و ایجاد بستری مناسب برای فعالیت های مشترک آنها نظارت داشته باشد.

4.       رئیس شورا مدیریت جلسات شورا را به عهده دارد و در صورت لزوم می تواند درخواست جلسات اضطراری کند.

ث) معاون هماهنگ کننده ی شورای حقوق بشر همجنسگرایان ایرانی

1.       معاون هماهنگ کننده ی شورای حقوق بشر همجنسگرایان ایرانی با رای اعضای هیئت موسسین و برای مدت یک سال انتخاب می شود و تنها می تواند دو دوره ی متوالی این مسئولیت را داشته باشد.

2.       وظیفه ی معاون هماهنگ کننده بررسی و یافتن موضوعات قابل پیگرد در شورا و پیشنهاد آن در جلسات می باشد.

3.       معاون هماهنگ کننده می بایست با مشورت گرفتن از جامعه ی دگرباشان ایرانی، موضوعات مورد اختلاف و یا نگرانی های موجود را به شورا منتقل کند.

ج) دبیر شورای حقوق بشر همجنسگرایان ایرانی

1.       دبیر شورای حقوق بشر همجنسگرایان ایرانی با رای اعضای هیئت موسسین و برای مدت یک سال انتخاب می شود و تنها می تواند دو دوره ی متوالی این مسئولیت را داشته باشد.

2.       وظیفه ی دبیر شورا تهیه ی صورت جلسه و گزارش فعالیت ها جهت ثبت و انتشار مصوبات شورا است

3.       دبیر شورا مسئول روابط عمومی و پاسخ گویی به ایمیل های شورا می باشد.

د) ساختار اجرایی شورای حقوق بشر همجنسگرایان ایرانی

1.       شورای حقوق بشر همجنسگرایان ایرانی یک نهاد مستقل حقوق بشری است و به هیچ گروه سیاسی، اجتماعی و مذهبی وابستگی ندارد و فعالیت های خود را فراجناحی انجام می دهد.

2.       شورا برای انتشار مصوبات و بیانیه های خود از ندا، نشریه دگرباشان ایرانی استفاده خواهد کرد.

3.       سازمان ها و گروه های عضو شورا به صورت مستقل اداره می شوند و عضویت در شورا به معنی ادغام آنها نمی باشد.

4.       تمام تصمیم گیری های شورا باید در جلسات رسمی اتخاذ شود.

5.       تمام مکاتبات شورا باید از طریق آدرس ایمیل ویژه ی شورای حقوق بشر همجنسگرایان ایرانی صورت پذیرد.

ذ) ساختار مالی شورای حقوق بشر همجنسگرایان ایرانی

1.       فعالیت اعضای شورا به صورت داوطلبانه شروع شده است و در قبال انجام این فعالیت ها دستمزدی دریافت نمی کنند.

2.       در صورت نیاز به اختصاص منابع مالی جهت انجام مصوبات، شورا موظف است که بودجه ی مورد نیاز را به صورت پروژه ارائه و منتشر نماید.

3.       شورا می تواند از تشکیلاتی که برای گسترش حقوق بشر حمایت مالی بدون تعهد می کنند، درخواست کمک نماید.

4.       شورا باید گزارش مالی پروژه را حداکثر یک ماه پس از اتمام آن جهت اطلاع عموم منتشر نماید.

ر) اعضای ناظر شورای حقوق بشر همجنسگرایان ایرانی

1- اعضای ناظر باید فعالیت های شناخته شده ای در زمینه ی حقوق بشر داشته باشند.

2- اعضای ناظر شورای حقوق بشر همجنسگرایان ایرانی می توانند در تمامی جلسات رسمی شورا حاضر شوند.

3- اعضای ناظر دارای حق رای مشاورتی می باشند و می توانند نقطه نظرات خود را در ارتباط با طرح ها و برنامه های شورا مطرح و شورا را در انجام تصمیماتش یاری و کمک رسانند.

4- چنانچه اختلافی بین اعضای ناظر شورا بروز نمود آنها می بایست به هیئت موسسین مراجعه نموده تا راهکاری برای حل اختلافات پیشنهاد گردد.

ز) انحلال شورای حقوق بشر همجنسگرایان ایرانی

در صورتی که اعضای شورا فعالیت های انجام شده را موثر تشخیص ندادند و در جلسات رسمی تصمیم به انحلال شورای حقوق بشر همجنسگرایان ایرانی گرفته شد با انتشار بیانیه ای آن را رسما منحل می کنند.

On December 10^th 2008, in the 60^th anniversary of the Universal Declaration of Human Rights, named as the year of decriminalization of homosexuality, the Iranian Homosexual Human Rights Council was founded by the aim of spreading the human rights of homosexuals in Iran.

I. The goals of the Iranian Homosexual Human Rights Council:

1. Trying to spread and abide by the homosexual human rights in Iran.

2. Trying to make a common goal for, and unite the Iranian homosexual organizations, groups, and communities.

3. Trying to decriminalize homosexuality in Iran

4. Holding purposeful and unified programs for abiding by the rights of homosexuals

5. Enlightenment and augmentation of the social acceptance of homosexuals in Iran

II) Founding Members of the Iranian Homosexual Human Rights Council:

1. Arshaam Parsi, Executive Director of the Iranian Railroad for Queer Refugees

2. Aria Iranaara, Director of the Iranian Homosexual Foundation

3. Mani Zaniar, Director of the Iranian LGBT Human Rights Organization

III) The administrative formation of the Iranian Homosexual Human Rights Council:

1. 1. Should a founding member decide to resign, he will need to candidate a substitute for his position. After the candidate is approved by the two other members of the board of the founders(or just funding members), he will gain the position.

2. Each member should take on one of the positions for; Executive Director, Executive Assistant, Communication Coordinator of the council.

3. In case legal or natural persons are willing to join the council as “supervising members”, they should therefore send their written request to the Communication Coordinator of the council, and regarding to the bylaw, all the permanent members should reach a complete agreement on their acceptance.

4. In case it is necessary, the members can change or complete the constitution in their official meetings.

IV) The Executive Director of the Iranian Homosexual Human Rights Council:

1. The Executive Director of the Iranian Homosexual Human Rights Council is elected by the permanent members’ votes and can only take on this position twice in succession, each time for a year long period.

2. The Executive Director is responsible to accomplish the general policies which are passed in the council meetings.

3. The Executive Director should observe the activities of the members and try to provide a suitable ground for their common activities.

4. The Executive Director should manage the council meetings and call for emergency ones.

V) The Executive Assistant of the Iranian Homosexual Human Rights Council:

1. The Executive Assistant of the Iranian Homosexual Human Rights Council is elected by the permanent members’ votes and can only take on this position twice in succession, each time for a year long period.

2. The duty of the council Executive Assistant is to find the pursuable subjects and to suggest them in the council meetings.

3. Having consulted the Iranian queer society, the Executive Assistant should inform the council about the discordant or worrisome matters.

VI) The Communication Coordinator of the Iranian Homosexual Human Rights Council:

1. The Communication Coordinator of the Iranian Homosexual Human Rights Council is elected by the permanent member’s votes and can only take on this post twice in succession, each time for a year long period.

2. The duty of the Communication Coordinator is to make records and to report the activities in order to register and publicize the resolutions of the council.

3. The council Communication Coordinator is responsible for public affairs and answering the council emails.

VII) The Administrative Structure of the Iranian Homosexual Human Rights Council:

1. The Iranian Homosexual Human Rights Council is an independent human rights institution and is not linked to any political, social or religious groups and works in a post partisan manner.

2. To release its resolutions and announcements, the council is going to use NEDA, the magazine of the Iranian queers.

3. The organizations and groups which have joined the council are run independently, and having this membership does not mean any combination.

4. All the decision makings must be done in official meetings.

5. All the correspondences must be done through the specific email address of the Iranian Homosexual Human Rights Council.

VIII) The Financial Structure of the Iranian Homosexual Human Rights Council:

1. The council members have started their activities voluntarily, so they do not earn any salaries.

2. In case of a need to dedicate financial sources for operating the resolutions, the council has to offer and publicize the needed budget in form of a project.

3. The council can demand help from the organizations which support human right activities without any commitments.

4. The council should the financial report of the project approximately a month after the end of the project.

IX) Supervising Members of Iranian Homosexual Human Rights Council:

1.    Supervising members need to have a considerable background of human rights activism.
2.    Supervising members of the Iranian Homosexual Human Rights Council are permitted to attend all the meetings of the council.
3.     Supervising members are entitled to advisory votes and are permitted to pass their viewpoints on projects and help the council
in decision making.
4.    Disagreements among supervising members need to be referred to the board of founders(or just founders or founding members) for
suggestions to end the disagreement.

X) Dissolution of the Iranian Homosexual Human Rights Council:

In case the council members do not find the activities fruitful, and decide to dissolve the IRanian Gay and Lesbian Human Rights Council in their official meetings, they will officially dissolve the council by publishing a declaration.
